Summary of changes brought about by the new wording of the Building Act

In order to harmonize the changes brought about by the completely new wording of the Building Act, more than 70 laws were amended and modified within the framework of the government's draft law on amendments to certain laws to meet the needs of the new Building Act to ensure continuity in the construction sector.

The new building law regulation also brought changes to the following legal regulations:

  1. Act No. 64/1997 Coll. on the use of land in established garden settlements and the settlement of ownership of them

In connection with the adoption of the new Building Act, the use of land in established garden settlements was modified. The changes concern two areas, namely:

  • Establishment of buildings on these lands and
  • Termination of the lease relationship by the land owner.


Establishment of buildings in garden settlements

  • From the point of view of the establishment of buildings in garden settlements, one of the most significant changes in the new construction law appears to be the clear definition of the term small buildings in Annex No. 2 of the new Construction Act, for which a decision on a building plan will not be required, but only their notification will be sufficient;
  • this will mainly concern cases where garden settlements are located in the built-up area of ​​a municipality;
  • the establishment of these small buildings by land users in garden settlements will therefore also be simpler and less administratively demanding;

Termination of the lease

One of the conditions under which the land owner may terminate this lease is the establishment of a building without a decision on the construction plan or without notifying the users

2. Act No. 314/2001 Coll. on Fire Protection

  • In connection with the adoption of the new Construction Act, the obligations of persons in the field of fire protection were also modified;
  • the changes will affect both the obligations of legal entities and natural persons-entrepreneurs as well as ordinary natural persons in preventing fires;
  • according to the new legal regulation, the solution to the fire safety of the building and the location of technological equipment will have to be developed by a fire protection specialist in the project documentation;
  • the fire protection specialist must subsequently ensure the documentation of the fire safety measures taken in the building, which will have to be part of the documentation of the actual construction of the building;
  • The documentation of the actual construction of the building is a textual and graphic documentation of the actual construction of the building and is the basis for the building approval;
  • details on the content and scope of the textual part and the graphic part of the fire safety solution for the building and for the location of technological equipment in the mandatory documentation shall be established by a generally binding regulation issued by the relevant ministry.
